1. Purpose

These Terms of Service (hereinafter the “Terms”) govern access to, installation of, and use of:

  • the Glyph Master software (including the local server, the Game Master screen, the player screen, the control panel, and all of its application components);
  • the glyph-master.com website;
  • the Cloud service used to host, synchronize, store, and share resources between users;
  • the compatible extensions, whether official or developed by third parties;
  • the animations, configurations, media, and creative content (Assets) created, imported, stored, or shared through the software or the Cloud service.

2. Acceptance of the Terms

BY CREATING AN ACCOUNT, BY INSTALLING THE SOFTWARE, BY USING THE SOFTWARE, THE WEBSITE, THE CLOUD SERVICE, THE EXTENSIONS, THE ANIMATIONS AND ASSETS, THE USER ACKNOWLEDGES AND ACCEPTS THESE TERMS OF SERVICE AS WELL AS THE PRIVACY POLICY OF GLYPH MASTER, WHICH FORMS AN INTEGRAL PART OF THE CONTRACTUAL FRAMEWORK GOVERNING THE SERVICE.

IN THE EVENT OF ANY DISAGREEMENT WITH THIS AGREEMENT OR ANY OF ITS UPDATES, THE USER MUST IMMEDIATELY CEASE ALL USE OF THE GLYPH MASTER SOFTWARE, ITS WEBSITE, AND ITS CLOUD SERVICE.

3. Nature of the Service: Hosting of Third-Party Content and Code

Glyph Master provides:

  • local software installed and executed on the user's computer;
  • an application-level Cloud service allowing the hosting, storage, and sharing of content, animations, and extensions generated or submitted by users.

As part of its Cloud service, Glyph Master acts exclusively as a host of third-party content and computer code. As such, Glyph Master benefits from the limited liability and safe-harbor regimes applicable in the relevant jurisdictions, including:

  • France: LCEN (Law for Trust in the Digital Economy);
  • European Union: Digital Services Act (DSA);
  • United States: DMCA Safe Harbor;
  • Canada: Copyright Act - “Notice-and-Notice” regime;
  • Australia: Copyright Act 1968 - Safe Harbour Scheme;
  • United Kingdom: E-Commerce Regulations (post-Brexit);
  • Japan: Provider Liability Limitation Act (Notice & Takedown);
  • New Zealand: Copyright Act 1994 - Safe Harbour.

In its capacity as a technical hosting provider, Glyph Master:

  • exercises no editorial control, systematic review, or a priori moderation over Animations, Assets, or Extensions uploaded by users;
  • is not legally responsible for the content of files, media, or the morality of the hosted computer code;
  • undertakes to promptly remove from its Cloud service any manifestly unlawful or infringing content or extension as soon as it becomes aware of it, in accordance with the reporting procedure described in Article 7;
  • will fully cooperate with competent judicial and administrative authorities to identify the authors of unlawful conduct.

4. Essential Obligations of Glyph Master

The essential obligations of Glyph Master are strictly limited to providing access to the software, the website, and the Cloud service as described in these Terms. No other feature, performance level, availability, compatibility, provision or preservation of Animations, Assets or Extensions, or continuity of service constitutes an essential obligation within the meaning of applicable law.

The service is provided “as is”, without any guarantee of error-free operation, uninterrupted access, absence of data loss, compatibility with third-party Extensions, or maintenance of existing functionalities. The obligations of Glyph Master constitute best-efforts obligations and not obligations of result.

The following do not constitute essential obligations: continuous availability of the Cloud service, preservation of Animations, Assets or Extensions, compatibility with future versions of the software, moderation of shared content, or correction of malfunctions.

No liability may be incurred against Glyph Master for any matter that does not expressly fall within the essential obligations defined in these Terms.

5. User Accounts and License Terms

Creating an account on https://glyph-master.com is required to use the software and to access the Cloud service.

Each new account is granted a 365-day Free license, subject to the limitations indicated on the website. A single account may not be used simultaneously on multiple computers.

Glyph Master grants the User a personal, limited, non-exclusive, non-transferable, non-assignable, and revocable license to install and use the software, for personal or professional purposes, provided that the User holds a valid license. Professional use is not permitted under the Free license and requires a paid license. In all cases, the use of the software must strictly comply with these Terms.

This license does not grant the User any ownership rights over the software, its components, its source code, or any associated intellectual property. All rights not expressly granted to the User remain the exclusive property of Glyph Master.

The User is expressly prohibited from:

  • copying, modifying, translating, decompiling, disassembling, reverse-engineering, or attempting to extract the source code of the software;
  • circumventing technical protection measures or license restrictions;
  • sharing, reselling, sublicensing, or transferring their account or license to any third party;
  • using the software in any manner that violates applicable law or infringes the rights of third parties.

Any violation of these Terms automatically results in the suspension or revocation of the User's license, without notice and without compensation, without prejudice to any legal action that Glyph Master may pursue.

6. User-Uploaded Content and Animations

6.1 Distinction Between Engine (Extension) and Content (Animation / Asset)

The Glyph Master ecosystem strictly distinguishes between two types of contributions:

  • Extensions: Executable code modules specifically governed by Article 9 of these Terms.
  • Animations and Content (Assets): Creative elements, media, and configurations shared by users on the Cloud service (images, videos, music, sound effects, models, texts, animation packages).

The user acknowledges that Extensions (whether developed by Glyph Master or by third parties) operate solely as neutral execution and rendering engines. Responsibility for any visual, textual, or audio content displayed or transmitted through these engines lies exclusively and entirely with the user who created, imported, or shared the Animation or Asset.

6.2 User Responsibility and Intellectual Property

The user is the sole and exclusive party responsible for the Animations and Assets they create, import, store, share, or make available through the Cloud service.

The user provides an absolute warranty that they hold all rights, licenses, authorizations, and necessary consents relating to intellectual, industrial, or commercial property (including, without limitation: copyrights, trademarks, patents, designs, neighboring rights, image rights, trade secrets, or distribution rights) for all elements and resources included or used in their shared content.

This warranty applies to any type of media or effect, whether material, immaterial, or sensory, including without limitation: visual, audio, and textual elements; textures; three-dimensional (3D) models; scripts; configuration data; as well as signals or instructions intended to trigger physical, lighting, olfactory, or tactile effects through connected devices.

6.3 Strictly Prohibited Content and Assets

It is strictly prohibited to upload, store on the Cloud service, or share Animations or Assets that are:

  • protected by copyrights, trademarks, or trade secrets without the express written authorization of the rights holder;
  • manifestly unlawful, including child sexual abuse material, pornography, or content promoting terrorism, war crimes, or crimes against humanity;
  • violent, graphic, hateful, defamatory, insulting, harassing, or inciting physical or psychological violence;
  • targeting or harming a gender, sexual orientation, origin, or maliciously mocking or attacking religious, political, or philosophical beliefs;
  • containing personal data or infringing upon the privacy of third parties without an explicit legal basis;
  • dangerous, malicious, or inciting illegal activities or the use of prohibited substances.

6.4 Classification, Moderation, and Removal Authority

The User has a legal and community obligation to correctly classify each uploaded content item by defining an appropriate age rating (audience) and warnings that accurately reflect the true nature of the content.

Classification is performed through the tagging system provided by the Platform. Mandatory tags must be selected from the categories defined by Glyph Master. Custom tags may be used as supplementary indicators, but shall in no event replace a mandatory tag or impair the clarity of the classification. Glyph Master may remove, rename, or block any custom tag deemed misleading, ambiguous, inappropriate, or non-compliant.

The user acknowledges that Glyph Master retains the discretionary right to review, hide, reclassify, or permanently remove any Animation or Asset deemed non-compliant, unlawful, or considered offensive or inappropriate according to the platform's moderation standards. Such actions may be taken without prior notice and without any obligation for Glyph Master to provide compensation, except where required by applicable law. Nothing in this clause shall prevent the user from exercising any non-waivable rights granted under applicable law.

In the event of non-compliance with these obligations or repeated reports, Glyph Master reserves the right to restrict, suspend, or permanently delete the User's account.

6.5 Downloading and Offline Use

When a user downloads an Animation or Asset from the Cloud service:

  • the local copy stored on the user's device permanently falls outside the technical and legal control of Glyph Master;
  • Glyph Master has technically no means to access or delete local copies already downloaded onto users' devices;
  • the use of such files in offline mode remains exclusively the responsibility of the end user.

Glyph Master's action in the event of a report or infringement is strictly limited to the removal of the content's availability on its Cloud service and cannot extend to copies archived locally by third parties.

6.6 Ownership of User-Created Animations and Assets

The User remains the sole holder of all intellectual property rights relating to the Animations, Assets, or any other content they create or import when using the software and the Cloud service, subject to the rights attached to third-party elements they may use (including, without limitation, open-source licenses, Creative Commons licenses, free-to-use content, or proprietary materials).

When the User incorporates into an Animation any element that is subject to a specific license (such as open-source licenses, Creative Commons licenses, commercial licenses, or proprietary content), all rights and obligations arising from that license apply in full. The User warrants that they comply with all usage, attribution, sharing, redistribution, or other conditions imposed by the relevant rights holders.

By uploading an Animation or Asset to the Cloud service, the User grants Glyph Master a worldwide, non-exclusive, free-of-charge, revocable, and strictly limited license for the purposes of hosting, storing, transmitting, displaying, and sharing the content with other Users, in accordance with the functionalities of the service. This license does not transfer any intellectual property rights to Glyph Master.

6.7. Use of Assets outside the Glyph Master ecosystem

All Assets (animations, configurations, media, and creative content) shared via the Cloud service or included within the Glyph Master software are intended exclusively for use within the framework of the Glyph Master software and its native functionalities. Any use, reproduction, modification, distribution, or exploitation of these Assets outside of the Glyph Master environment—including, but not limited to, their integration into other software, their publication on video streaming platforms, or their use in third-party projects—is strictly prohibited without the express prior authorization of their rights holder.

For official Assets, such authorization must be requested directly from the publisher of Glyph Master. For any other Asset shared by the community, the user must obtain formal consent from the original author of the shared content. Glyph Master acts solely as a technical host and is not a party to, guarantor of, or mediator in any exploitation agreements concluded between users. Glyph Master disclaims all liability regarding any disputes, damages, or intellectual property violations arising from the unauthorized use of Assets outside of its ecosystem.

7. Takedown and Reporting Procedure

Any person who believes that content hosted via Glyph Master infringes upon their rights may report it to the publisher of Glyph Master. Glyph Master provides simple tools to report any illicit content or content that infringes upon your rights.

You can make a report:

  • Via our dedicated form: accessible at the address Report illicit content.
  • Directly from the content pages: every page displaying shared content features a built-in report button to facilitate quick action.

The notification must include at a minimum:

  • the URL or identifier of the content concerned;
  • a description of the alleged infringement;
  • the complainant's full contact details;
  • a sworn statement regarding the accuracy of the information provided.

In accordance with applicable laws, Glyph Master commits to processing notifications as follows:

  • France / EU: prompt removal of manifestly illicit content (LCEN / DSA);
  • USA: DMCA procedure (takedown and, where applicable, counter-notification);
  • Canada: forwarding the notification to the concerned user (Notice-and-Notice);
  • Australia / UK / Japan / New Zealand: rapid removal in accordance with their respective Safe Harbour / E-Commerce frameworks.

Glyph Master reserves the right to suspend or delete an account in the event of repeated or manifest violations of copyright or these ToS.

8. Local Data and Privacy

Glyph Master does not store local game data (boards, animations, media, configurations) on its servers. Such data is stored exclusively on the User's computer, within the directory defined during installation.

The Cloud service only stores content that the User explicitly uploads for the purpose of sharing it with other Users.

The User is responsible for:

  • backing up and preserving their local data;
  • protecting and securing their computing environment;
  • properly configuring their storage directories.

Glyph Master cannot be held liable for any loss, corruption, or deletion of local data.

The processing of personal data carried out in connection with the use of the software, the website, or the Cloud service is governed by the Privacy Policy of Glyph Master, available on the platform. By using the service, the User acknowledges having read said Policy, which forms an integral part of these Terms.

9. Use of Third-Party Extensions

Glyph Master allows the user to install and activate extensions developed by third parties. These optional modules are intended solely to enhance the user's gameplay experience (custom overlay management, audio processing, control of DMX or IoT stage equipment, etc.).

NON-WARRANTY CLAUSE FOR THIRD-PARTY CODE AND CONTENT:

THIRD-PARTY EXTENSIONS ARE MADE AVAILABLE TO THE USER “AS IS” AND “AS AVAILABLE.” GLYPH MASTER EXERCISES NO EDITORIAL CONTROL AND DOES NOT CERTIFY THE SOURCE CODE NOR ANY CREATIVE ELEMENTS EMBEDDED IN OR DISTRIBUTED THROUGH SUCH MODULES.

ALTHOUGH A TECHNICAL FILTERING PROCESS MAY BE APPLIED WHEN AN EXTENSION IS SUBMITTED TO THE CLOUD SERVICE, THIS MECHANISM IS AN INTERNAL PRECAUTIONARY MEASURE INTENDED SOLELY TO DETECT MANIFEST THREATS. THIS PROCESS DOES NOT CONSTITUTE A PROFESSIONAL SECURITY AUDIT, NOR A CERTIFICATION OF THE ABSENCE OF VULNERABILITIES OR MALICIOUS INTENT, NOR A VALIDATION OF THE COMPLIANCE OF THE EMBEDDED CONTENT. ACCORDINGLY, GLYPH MASTER DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTY REGARDING THE SECURITY, STABILITY, ACTUAL BEHAVIOR, OR LEGALITY OF THE MEDIA (IMAGES, SOUNDS, TEXTS) EMBEDDED OR USED BY THIRD-PARTY EXTENSIONS. THE USER ACKNOWLEDGES THAT THE DEPLOYMENT OF SUCH MODULES IS PERFORMED UNDER THEIR SOLE AND ENTIRE RESPONSIBILITY, AFTER ASSESSING THE INHERENT RISKS ASSOCIATED WITH EXECUTING THIRD-PARTY CODE ON THEIR SYSTEM.

EXCLUSIVE RESPONSIBILITY OF THE END USER:

IN ACCORDANCE WITH THE CONTEXTUAL AND EXPLICIT WARNING DISPLAYED THROUGH A VALIDATION WINDOW (POPUP) PRIOR TO ANY INSTALLATION, THE ACTIVATION, DOWNLOAD, AND LOCAL EXECUTION OF A THIRD-PARTY EXTENSION ARE PERFORMED AT THE USER'S OWN RISK TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. BY VALIDATING THIS POPUP, THE USER CONFIRMS THEIR UNDERSTANDING AND ACCEPTANCE OF THE ASSOCIATED RISKS. THE USER ACKNOWLEDGES THAT THEY ARE PRIMARILY RESPONSIBLE FOR:

  • THE PRIOR ASSESSMENT OF RISKS RELATED TO THE EXECUTION OF THIRD-PARTY SOFTWARE CODE ON THEIR COMPUTER SYSTEM;
  • THE SECURITY AND PROTECTION OF THEIR MACHINE AND LOCAL NETWORK (INSTALLATION AND UPDATING OF ANTIVIRUS SOFTWARE, CONFIGURATION OF FIREWALLS AND ACCESS RIGHTS);
  • VERIFYING THE LEGAL COMPLIANCE OF ANY CONTENT DISPLAYED OR USED BY THE EXTENSION (INCLUDING THE ABSENCE OF COPYRIGHT INFRINGEMENT, IMAGE RIGHTS VIOLATIONS, OR ANY OTHER THIRD-PARTY RIGHTS) DURING THEIR GAME SESSIONS;
  • COMPLYING WITH ELECTRICAL, PHYSICAL SAFETY, AND ANY APPLICABLE LOCAL REGULATIONS WHEN USING HARDWARE CONTROLLED BY SUCH EXTENSIONS (LIGHTING, DMX EQUIPMENT, CONNECTED OUTLETS, HOME AUTOMATION OR SENSOR DEVICES), AS WELL AS ANY OTHER EQUIPMENT, DEVICE, OR APPARATUS, PRESENT OR FUTURE, THAT MAY BE CONTROLLED BY THESE EXTENSIONS, REGARDLESS OF ITS TYPE OR PURPOSE;
  • VERIFYING COMPLIANCE WITH PRIVACY AND DATA PROTECTION LAWS FOR ANY DATA THAT MAY BE COLLECTED OR PROCESSED BY SUCH EXTENSIONS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GLYPH MASTER SHALL NOT BE LIABLE FOR ANY UNDESIRED EFFECTS, UNDOCUMENTED BEHAVIOR, OR CRITICAL DAMAGE CAUSED BY A THIRD-PARTY EXTENSION, INCLUDING BUT NOT LIMITED TO: HIDDEN CRYPTOMINING INTENT, PHISHING SCRIPT INJECTION, MALWARE OR TROJAN DEPLOYMENT, UNAUTHORIZED EXFILTRATION OF PERSONAL DATA, OR THE DISPLAY OR TRANSMISSION OF UNLAWFUL, ILLEGAL, INFRINGING, CHILD-SEXUAL-ABUSE, OFFENSIVE, OR OTHERWISE PROHIBITED CONTENT, OR CONTENT VIOLATING THIRD-PARTY INTELLECTUAL PROPERTY OR INDIVIDUAL RIGHTS. NOTHING IN THIS CLAUSE SHALL EXCLUDE OR LIMIT LIABILITY WHERE SUCH EXCLUSION OR LIMITATION IS PROHIBITED BY LAW.

USERS ARE ENCOURAGED TO REPORT ANY EXTENSION CONTAINING DISPUTED CONTENT OR CODE THROUGH THE PROCEDURE DESCRIBED IN ARTICLE 7 OF THESE TERMS, SO THAT GLYPH MASTER MAY TAKE APPROPRIATE ACTION REGARDING ITS AVAILABILITY ON THE CLOUD SERVICE.

USERS MUST PROMPTLY REPORT ANY EXTENSION CONTAINING DISPUTED, UNLAWFUL, INFRINGING OR MALICIOUS CONTENT OR CODE THROUGH THE PROCEDURE DESCRIBED IN ARTICLE 7 OF THESE TERMS, SO THAT GLYPH MASTER MAY TAKE APPROPRIATE ACTION REGARDING ITS AVAILABILITY ON THE CLOUD SERVICE. THIS REPORTING OBLIGATION IS A CONTRACTUAL DUTY OF COOPERATION AND DOES NOT CREATE ANY FORM OF LEGAL LIABILITY WHERE SUCH LIABILITY WOULD BE PROHIBITED BY APPLICABLE LAW.

10. Service Availability, Maintenance and Third-Party Content

Service Availability and Maintenance

The User acknowledges that the software, the website, and the Cloud service of Glyph Master are provided “as is”, without any guarantee of availability, continuity, or uninterrupted operation. No service level agreement (SLA) is guaranteed, and no corrective or evolutionary maintenance obligation is imposed on Glyph Master.

Glyph Master reserves the right to modify, suspend, interrupt, or limit all or part of the service at any time, without notice and without any compensation being owed to the User, unless otherwise required by mandatory law.

In the event of a permanent shutdown of the service or a prolonged suspension, automatic billing for paid licenses is stopped immediately. No partial refund or prorated reimbursement is owed for the current billing period.

In the event of a complete Cloud service outage lasting more than 5 consecutive days, Glyph Master may, at its sole discretion, extend the validity period of affected paid licenses. This measure is purely commercial and does not constitute a legal or contractual obligation. No extension or compensation is granted for Free licenses.

When the software or the service is used in a professional context (actual play productions, professional game mastering, events, conventions, associations, companies), the User expressly acknowledges that Glyph Master cannot be held liable for any damages, financial losses, penalties, lost profits, indirect damages, or consequences arising from any interruption, malfunction, or unavailability of the service.

The User remains solely responsible for implementing any necessary backup, redundancy, or alternative solutions required for their professional activity. Glyph Master assumes no obligation of repair, priority support, or service continuity.

Availability of User-Shared Animations, Assets, and Third-Party Extensions

Access to Animations, Assets, and Extensions shared through the Cloud service depends entirely on the availability of the service and the technical infrastructure of Glyph Master. In the event of an interruption, maintenance, outage, or access limitation, such content may become temporarily or permanently inaccessible.

Glyph Master cannot be held liable for the unavailability, loss of access, deletion, corruption, or malfunction of Animations, Assets, or Extensions, whether created by Users or developed by third parties. Such content is provided and shared under the sole responsibility of its authors.

Third-party Extensions, as well as Animations and Assets shared by Users, may cease to function partially or entirely following an update, a technical change, an incompatibility, or a service interruption. Glyph Master assumes no obligation to maintain compatibility or provide support for such third-party content.

When the software or the service is used in a professional context, the User expressly acknowledges that Glyph Master cannot be held liable for any damages, financial losses, penalties, lost profits, indirect damages, or consequences arising from the unavailability or malfunction of the service, Animations, Assets, or Extensions.

11. Use of the Service by Minors

The use of the Glyph Master software, website, and Cloud service by a minor is subject to the prior authorization of their legal representative. The minimum age required to create an account or use the service depends on the legislation of the User's country of residence.

The minor's legal representative remains solely responsible for the minor's use of the service, including access to Animations, Assets, and Extensions shared by Users. Glyph Master cannot be held liable for a minor's exposure to content that is inappropriate or not suitable for their age.

Glyph Master does not carry out any systematic verification of Users' ages and cannot be held liable if a minor circumvents age restrictions. In the event of a clear violation, Glyph Master may suspend or delete the account concerned.

The legal representative acknowledges that it is their responsibility to implement the necessary parental controls and to supervise the minor's use of the service.

The User acknowledges that certain Animations or Assets may be classified for a specific audience in accordance with Article 6.4. Classification is performed exclusively by the content's author, under their sole responsibility. Glyph Master does not guarantee the accuracy or relevance of such classifications and cannot be held liable if a minor accesses inappropriate content due to incorrect classification or lack of parental supervision.

12. End of License, Account Termination and Treatment of Content

12.1 Expiration or Non-Renewal of a License

The expiration of a license, whether a free license (Free License) or a monthly subscription, does not result in the deletion of the User's account. Upon expiration of the license, access to the Cloud service and certain features may be suspended until the license is renewed or a new license is purchased.

Animations, Assets and Extensions created by the User remain stored for a reasonable period of time to allow reactivation of the account. After this period, Glyph Master may proceed with their anonymization or deletion, in accordance with the Privacy Policy and these Terms.

12.2 Voluntary Account Termination by the User

The User may terminate their account and stop using the service at any time from their personal space or by submitting a request to Glyph Master. Termination results in the deactivation of account access and the immediate cessation of billing for paid licenses. No partial refund or prorated reimbursement is owed for the current billing period.

The User may request, upon termination:

  • the permanent deletion of their Animations and Assets;
  • their anonymization (removal of the author's name);
  • their retention with attribution (author's name preserved).

If no explicit choice is expressed before the account is closed, public content is anonymized by default to ensure continuity of the service, in accordance with the Privacy Policy. Private content may be deleted.

12.3 Termination by Glyph Master

Glyph Master may terminate an account in the event of a clear violation of these Terms, fraud, circumvention of age restrictions, or abusive behavior. No refund is owed in the event of termination for contractual breach.

In the event of enforced termination, the User's public content may be anonymized to ensure continuity of the service. Glyph Master may also proceed with its deletion where its retention would be incompatible with these Terms or with applicable law.

12.4 Effects of Termination

Termination of the account, whether voluntary or enforced, does not affect the User's prior obligations, including in the event of a violation of these Terms or outstanding amounts owed.

Glyph Master is not required to retain or restore content deleted after termination, except where otherwise required by law.

13. Limitation of Liability

ABSOLUTE DISCLAIMER OF LIABILITY:

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GLYPH MASTER, ITS PUBLISHER, OFFICERS, EMPLOYEES, OR PARTNERS SHALL IN NO EVENT BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM THE USE OR INABILITY TO USE THE SOFTWARE OR THE CLOUD SERVICE.

THIS EXCLUSION APPLIES IN PARTICULAR, BUT WITHOUT LIMITATION, TO THE FOLLOWING DAMAGES:

  • LOSS, DELETION, UNAUTHORIZED ACCESS TO, OR CORRUPTION OF LOCAL OR CLOUD-HOSTED DATA;
  • HARDWARE, SOFTWARE, OR SYSTEM DAMAGE RESULTING FROM THE EXECUTION OF THIRD-PARTY EXTENSIONS (VIRUSES, MALWARE, TROJANS, PHISHING TOOLS, OR SPYWARE);
  • INFRINGEMENT OF THIRD-PARTY INTELLECTUAL, INDUSTRIAL, OR COMMERCIAL PROPERTY RIGHTS CAUSED BY ANIMATIONS, ASSETS, OR EXTENSIONS DEVELOPED AND SHARED BY USERS (INFRINGEMENT OF MUSIC, IMAGES, TRADEMARKS, VISUALS, TEXTS, OR USE OF PATENTED TECHNOLOGIES);
  • THE DISTRIBUTION BY THIRD PARTIES OF ILLEGAL, UNLAWFUL, CHILD-SEXUAL-ABUSE, TERRORIST, OFFENSIVE, INAPPROPRIATE, OR DEGRADING CONTENT, OR CONTENT THAT HARMS HUMAN DIGNITY, GENDER, BELIEFS, OR PRIVACY THROUGH MODULES OR THE CLOUD SERVICE;
  • FINANCIAL LOSSES, LOSS OF REVENUE, OR BUSINESS INTERRUPTIONS RELATED TO API INTEGRATIONS, WEB SERVICES, OR EXTERNAL TOOLS.

GLYPH MASTER'S LIABILITY IS FORMALLY EXCLUDED FOR ANY ACT, OMISSION, MALICIOUS CODE, OR UNLAWFUL CONTENT RESULTING FROM THE DIRECT OR INDIRECT ACTION OF A USER OR THIRD-PARTY DEVELOPER.

LIMITATION OF DAMAGES TO A MAXIMUM AMOUNT:

IN THE EVENT THAT GLYPH MASTER'S LIABILITY IS RECOGNIZED AND ESTABLISHED BY A COMPETENT COURT DESPITE THE ABOVE DISCLAIMER CLAUSES, SUCH LIABILITY SHALL BE STRICTLY AND GLOBALLY LIMITED TO THE TOTAL AMOUNT ACTUALLY PAID BY THE USER FOR ACCESS TO THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR TO A FLAT AMOUNT OF FIFTY EUROS (50 €) IF THE USER IS USING A FREE LICENSE (FREE LICENSE).

Mandatory Provisions and Legal Limitations

Nothing in these Terms shall operate to exclude or limit any liability where such exclusion or limitation would be prohibited under applicable law, including in cases of personal injury, intentional misconduct, gross negligence, or with respect to statutory guarantees that cannot be excluded.

14. Suspension and Account Deletion

Glyph Master reserves the discretionary right to suspend, restrict access to, or permanently delete a user account, as well as to ban access to its Cloud service, immediately and without prior notice, formal demand, or compensation, in the following cases:

  • proven violation or legitimate suspicion of violation of these Terms of Service;
  • failure to comply with third-party copyrights, trademarks, or intellectual or industrial property rights;
  • sharing, storing, or distributing prohibited, unlawful, infringing, or offensive content or assets within the meaning of Article 6;
  • installation, activation, or attempted distribution through the Cloud service of extensions containing malicious code, phishing scripts, cryptocurrency miners, or any undocumented behavior within the meaning of Article 9;
  • abusive, fraudulent, unauthorized automated, or malicious use of the software or Cloud service that endangers Glyph Master's infrastructure or the security of other users;
  • repeated, serious, and substantiated reports from the community or rights holders concerning the account's activity.

A user whose account is suspended or deleted for breach of these Terms is not eligible for any refund, whether full or partial, of any amounts paid on the platform. Glyph Master cannot be held liable for any data loss or service interruption resulting from the application of this security measure.

15. Amendments to the ToS

Glyph Master may amend these Terms of Service at any time, in particular to reflect changes in the service, legal or regulatory requirements, or industry best practices.

Minor amendments (corrections, clarifications, or technical adjustments that do not significantly affect Users' rights or obligations) take effect immediately upon their publication on the website, within the software, or through an integrated Cloud service notification.

Substantial amendments affecting Users' rights or obligations will be communicated in advance, through publication on the website, notification within the software, or by email, at least fifteen (15) days before they take effect, unless an immediate application is required by law.

Continued use of the service after the amended Terms take effect constitutes acceptance of the changes. If the User does not accept substantial amendments, they may discontinue use of the service and terminate their account in accordance with the procedures set out in these Terms, including those described in Article 12 regarding the effects of termination.

Amendments required by law, court order, or a competent administrative authority may take effect immediately, without prior notice, where such immediate application is mandated.

16. Governing Law and Jurisdiction

These Terms of Service are governed by French law, subject to the mandatory provisions of European Union law and any applicable local legislation for Users located outside the European Union.

Depending on the User's location, the following regimes may additionally apply, particularly with respect to hosting liability, content removal procedures, or notice requirements:

  • France / European Union: French law, GDPR, LCEN, Digital Services Act (DSA);
  • United States: DMCA Safe Harbor (17 U.S.C. §512);
  • Canada: Copyright Act - “Notice-and-Notice” regime;
  • Australia: Copyright Act 1968 - Safe Harbour Scheme;
  • United Kingdom: E-Commerce Regulations and applicable UK law;
  • Japan: Provider Liability Limitation Act;
  • New Zealand: Copyright Act 1994 - Safe Harbour.

Any dispute relating to the interpretation, performance, or validity of these Terms shall, unless otherwise required by mandatory law, fall under the exclusive jurisdiction of the courts of the registered office of the publisher of Glyph Master.

Where the User's local law imposes a different mandatory jurisdiction or legal regime (including consumer protection, liability, or content removal obligations), such provisions shall prevail strictly to the extent required.
